You may pay by credit card for online purchases
from Post Marine Supply. We accept Visa, MasterCard, and American
Express only. All transactions are conducted in US Dollars only.

We accept checks and money orders in US
Dollars as valid forms of payment. If you wish to pay by check

Post Marine Supply must receive your payment
within 10 calendar days of placing your order or your order will
be cancelled. We will not ship any orders until your check has
cleared. Please allow 14 business days for this process.
Privacy and Security
Post Marine Supply is committed to protect
your privacy. We will use the information you provide only
for the purpose of processing your order. We do not sell,
trade, or rent your personal information to others. Post
Marine Supply may release account information when we believe,
in good faith that such release is reasonable and necessary
to comply with law, enforce, or apply the terms of any of our
user agreements, or protect the rights, property, or safety of
Post Marine Supply, our users, or others. We collect no other
personal information about you other than what you provide during
the checkout process.
Personal Information Collected:
In order to process your online order,
we require your name, email address, credit card number, expiration
date, the billing address of your credit card, shipping address
if different than your credit card billing address and a contact
phone number. This allows us to process and fulfill your
order and to notify you of your order status.
Protecting Your Personal Information
When you provide us your personal information
to process your online order, we receive this information using
a secure Internet server employing the industry standard secure
transmission protocol known as SSL (Secure Socket Layer). SSL
encrypts all personal information you send us, ensuring that this
information is sent to us in a private and secure manner. Once
received, all of your personal information is protected against
unauthorized access.
A Post Marine Supply representative will only ask you for
credit card information if they are taking an order placed by
phone. We will never contact you by phone or email to ask for
your credit card information (unless the original information
was incorrect or invalid). If you receive a phone call or email
requesting such information — DO NOT PROVIDE ANY PERSONAL OR FINANCIAL
INFORMATION. Instead, contact us by phone, fax, or email
below and let us know that you have been contacted. A Post
Marine Supply representative may contact you by phone or email
to confirm the details of your order if required for fulfillment.
Consent
By using our Web-Site, you consent to the
collection and use of your personal information by Post Marine
Supply. If we change our Privacy Policy, we will post the changes
to this page so that you are always aware of the information we
collect, how we use it, and under what circumstances we disclose

State Sales Taxes
Post Marine Supply will only collect sales
tax on purchases shipped within New York State. Out of state
customers will not be charged sales tax.
The actual taxes charged to your credit
card will reflect the applicable state and local sales taxes at
the time your order is placed. Tax will be charged to your total
purchase and to your shipping charges where applicable.
Returns Policy
If your product is defective in anyway
please call our Customer Service Representatives at (800) 922-4837
or (914) 235-9800 for an RMA number. Most defective goods will
be replaced upon receipt of the defective product. All “DEAD ON
ARRIVAL” (DOA) returns must be returned within 7 days of receipt,
all non-defective returns must be returned within 30 days and
are subject to a 25% restocking fee. Restocking fees do not apply
to defective merchandise that is being replaced.
All Special Order items are not returnable. Non-defective
refused goods are subject to a 25% restocking fee, plus all shipping
charges incurred to and from original destination.
VISIBLE SHIPPING DAMAGE MUST BE REPORTED
IMMEDIATELY. CONCEALED DAMAGES MUST BE REPORTED WITHIN 24 HOURS
OF RECEIVING THE PRODUCT. POST MARINE SUPPLY WILL NOT BE HELD
RESPONSIBLE FOR ANY DAMAGES REPORTED AFTER 24 HOURS.
- Our quality assurance
team inspects each product at the warehouse to insure they were
received from the factory in perfect condition before sending
them out to a customer.
- Returning products
with the warranty card completed or goods not in their original
packaging will be refused. Products are shipped via freight
carrier and are insured for safe arrival.
- All returns must
be in a resalable condition including, original packaging and
packaging materials, all accessories, cords, cartons, cables,
and documentation, warranty materials and registration, and
like-new condition of the of the merchandise and packaging materials.
In order to issue the RMA we need:
- Your name or company
name, invoice number, item or model number, and/or product serial
number of the product
- Date of shipment,
and overview of the problem
- A daytime phone
telephone number you can be reached at
- Your e-mail address
(if applicable)
- Please do not
write the RMA number on the box. This makes it non-resalable
and you will be charged for replacing the box. Please display
the number on the shipping label.
What if I don't like the product and
want a refund?
- All returns of
non-faulty goods are subject to a 25% restocking fee. No refund
or
exchange after 30 Days.
- Postmarine.com
is not held responsible for any returned shipping charges.
- All sales are final
on special order items which include: Boat lettering, boats,
motors, batteries, electronics, charts, and cut goods (with
the exception of items shipped in error). These items cannot
be returned for exchange or refund.
What if my item/unit arrives broken?
- IF DAMAGE IS
OBSERVED, PLEASE REFUSE THE DELIVERY AND HAVE THE DRIVER RETURN
THE UNIT IMMEDIATELY.
Report all physical damage to the driver, and have them
clearly mark the Bill of Lading (shipping invoice) before signing.
- CUSTOMERS CAN NOT
PICK-UP INTERNET ORDERS AT THE SHIPPING WAREHOUSE. Post Marine
Supply will not be responsible for shipping damage of any kind
if the unit has been picked up, driven to your address, and
signed for on the shippers invoice (bill of lading).
- We advise that
you only let the shipping companies handle delivery to your
address.
- Our window of
opportunity to file a claim with the shipping companies is limited.
Please DO NOT sign the bill of lading until you have fully inspected
the unit for damage.
- Once you have opened
the box while the driver waits, please check the unit/item for
cracks or any other type of physical damage. If everything looks
good, then sign the shipping invoice (bill of lading).
What do I do once my Item is delivered?
- Please open and
inspect the Item(s) for physical damage immediately! Have the
driver wait. Report all physical damage to the driver, and have
them clearly mark the Bill of Lading (shipping invoice) before
signing.
- IF DAMAGE IS OBSERVED,
PLEASE REFUSE THE DELIVERY AND HAVE THE DRIVER RETURN THE UNIT
IMMEDIATELY. Our window of opportunity to file a claim with
the shipping companies is limited. Please inspect the item(s)
for any damages while the driver waits. Note any physical damage
to the display box on this bill of lading invoice. If you notice
any shipping damage, please refuse the shipment and we will
send you an instant replacement. DAMAGE IS EXTREMELY RARE, YET
WE WANT TO SEND YOU A NEW REPLACEMENT AS SOON AS WE POSSIBLY
CAN. Taking a few minutes can save you several days of shipping
delays. If everything looks good, then sign the shipping invoice
(bill of lading).
- VISIBLE SHIPPING
DAMAGE MUST BE REPORTED IMMEDIATELY. CONCEALED DAMAGES MUST

Shipping Methods and Options
Our standard method of shipping within the forty eight contiguous
United States is UPS Ground. In addition to shipping time
please allow 5 business days for us to process your order, 7-10
business days to deliver.
We offer free ground shipping on
all orders over $100.00 – up to 25lbs. Free Ground Shipping
is available within the contiguous United States. Not valid
on shipments to Alaska or Hawaii. Offer only good on orders
up to 25lbs. and over $100.00. This is an internet offer
only. This does not apply to oversized, hazardous, or special
orders.
For orders under $100.00 or over 25lbs.
you will be charged actual shipping costs. Our website
is linked directly to UPS; therefore you will pay exact shipping
costs based on the items in your shopping cart and your ship to
address.
Orders shipped to Alaska and
Hawaii must use Next Day Air or 2nd Day Air
service. These rates are also actual shipping costs.
We also offer expedited shipping options
within the US.
Orders to be shipped via Next Day Air or 2nd Day Air
must be placed by 1 PM EST in order to be shipped same day (subject
to availability).
All Shipments are subject to stock availability.
Post Marine Supply does not guarantee estimated ship times included
on the Web-Site, nor does Post Marine Supply guarantee any claims
made by any carrier.
Due to the varying weight and dimensions
of our products, some items may require additional shipping
and/or handling charges. If applicable shipping
and/or handling charges apply, you will be contacted after order
receipt, or simply call our sales department at 800-922-4837 or
914-235-9800 to ensure the shipping price indicated on Web-Site
includes special weight and/or dimensional requirements prior
to purchase. Often oversized items will be shipped via
truck delivery service. If so indicated for your order, you will
be notified prior to shipment of rates.
Multiple Shipping Addresses
You may request shipping items to separate mailing addresses,
ONLY by placing separate orders for each destination. This will
increase your shipping costs.
Shipping to a P.O. Box, APO or FPO
Because of UPS limitations, Post Marine Supply cannot ship
any items to a Post Office box, APO, or FPO via UPS. UPS requires
a street address for all deliveries. Please be sure to enter
a complete shipping address for all online orders.
If you wish to have an item shipped to
a P.O. Box, APO, or FPO, please call 800-922-4837
or 914-235-9800 to place your order. These orders will ship via
US Postal Service. Shipping charges will be calculated at that
time.
International Orders & Shipping
International Orders (orders outside
the United States) are accepted, however all payments must be
made in the form of a Credit Card or Bank Wire Transfer in US
Dollars. For international orders including Canada, Puerto
Rico, and the Dominican Republic, please call 1-800-922-4837
or 914-235-9800 to place your order.
Shipping costs will be calculated at that
time and are subject to increase depending upon the destination.
Pricing and Typographical
Errors
Due to the fast pace of the computer and
consumer products industries, all prices are subject to change
without notice. We make every effort to provide you the most accurate,
up-to-the-minute information. Despite our best efforts, a small
number of the items on our Web-Site may be mis-priced.
In the event a product is listed at an
incorrect price due to typographical, photographic, or technical
error or error in pricing information received from our suppliers,
Post Marine Supply shall have the right to refuse or cancel any
orders placed for product listed at the incorrect price.
- If an item's correct
price is lower than our stated price, we will charge the lower
amount and ship you the item.
- If an item's correct
price is higher than our stated price, we will cancel your order
and notify you of the price error and order cancellation. You
will, of course, have an opportunity to purchase the item at
the correct price, if you so wish.
While we make every attempt to verify prices
before charging your credit card, Post Marine Supply shall have
the right to refuse or cancel any orders placed on mis-priced
product whether or not the order has been confirmed and your credit
card charged. If your credit card has already been charged for
the purchase and your order is canceled, Post Marine Supply will
immediately issue a credit to your credit card account in the
amount of the incorrect price.
The advertisement of any product on this
site does not constitute an offer to sell. Your order or your
receipt of an electronic or other form of order confirmation does
not signify our acceptance of your order, nor does it constitute
confirmation of our offer to sell. Post Marine Supply reserves
the right at any time after receipt of your order to accept or
decline your order. Post Marine Supply reserves the right at any
time after receipt of your order, without prior notice to you,
to supply less than the quantity you ordered of any item in accordance
with our order limitation policy.
All orders placed must obtain pre-approval
with an acceptable method of payment, as established by our credit
department. We may require additional verifications or information
before shipping any order. Please allow 12 - 48 hours for order
processing and address verification.
TERMS OF PURCHASE
The terms and conditions set forth in these terms of purchase
(this “Agreement”) and the “Terms of Access” constitute the entire
agreement between Post Marine Supply, (“Post Marine Supply,”)
and you (the “Buyer”) concerning product purchase through the
Web-Site. Capitalized terms used herein shall have the meaning
as defined herein, or if not defined, as defined in the Terms
of Access.
1. Offer and Acceptance
By ordering a product on the Web-Site, Buyer shall be deemed to
have made an offer to buy the specified product from Post Marine
Supply pursuant to this Agreement. The acceptance and fulfillment
by Post Marine Supply, of any order placed on the Web-Site is
subject to Buyer's acceptance of all of the terms of this Agreement.
2. Prices, Availability, and Taxes
Prices of product on the Web-Site are subject to change at any
time without notice. All products may not be available in
all areas. Product availability is subject to change at
any time and Post Marine Supply makes no representations of warranties
regarding product availability. Buyer shall be responsible for
any tax or other governmental charge due to the sale, use or delivery
of the product, including, but not limited to, Sales Tax, Use
Tax, Retailer's Occupational Tax, Gross Revenue Tax, Value Accrued
or Value Added Tax, and Transportation Tax. All applicable taxes
and other charges will be added to the purchase price. Post
Marine Supply’s product pricing is competitive, changing frequently.
Post Marine Supply does not offer price protection on any purchases.
After placing your order, if the product drops below your original
purchase price no credits or further incentives will be given
in exchange for the price difference.
3. Payment
When ordering products on the Web-Site, buyer may use VISA, MASTERCARD,
or AMERICAN EXPRESS. Please be sure to provide your exact billing
address and telephone number (the address and phone number your
credit card bank has on file for you). Incorrect information may
cause a delay in processing your order. Your credit card will
be billed upon shipment of your order.
Post Marine Supply will only accept checks
or money orders on orders mailed to Post Marine Supply. For
money orders or checks, please allow up to 2 weeks after receipt
for clearance of funds before the order is processed. Post Marine
Supply cannot guarantee the availability of a product by the time
funds clear or payment is received. Post Marine Supply will
not accept any COD orders. If Buyer fails to pay for any products
received, Post Marine Supply shall have the right, in addition
to other remedies, to suspend or cancel further deliveries, and
to proceed in any court of proper jurisdiction against Buyer for
all amounts due to Post Marine Supply, including, but not limited
to, attorney fees, costs and interest.
4. Shipping, Title, and Risk of Loss
Post Marine Supply will ship products using the shipping method
selected by Buyer on the Web-Site. All sales are made F.O.B.,
the shipping point. Post Marine Supply shall use reasonable efforts
to cause products to be delivered to Buyer by requested delivery
dates, but shall in no event be liable for any losses or damages
caused by delay or non-delivery of products. Buyer shall be responsible
for all shipping charges, except where indicated. Title and risk
of loss in the products shall pass to Buyer upon Post Marine Supply’s
(or its agent's) delivery to the carrier at the shipping point.

POST MARINE SUPPLY MAKES NO REPRESENTATIONS OR WARRANTIES,
EITHER EXPRESSED OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS
SOLD ON THE POST MARINE WEB-SITE. EXCEPT AS EXPRESSLY STATED HEREIN,
POST MARINE SUPPLY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESSED
OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS SOLD ON THIS
SITE, INCLUDING BUT NOT LIMITED TO, MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE. YOU AGREE THAT THE SOLE AND EXCLUSIVE
MAXIMUM LIABILITY TO POST MARINE SUPPLY ARISING FROM ANY PRODUCT
SOLD ON THE POST MARINE WEB-SITE SHALL BE THE PRICE OF THE PRODUCT
ORDERED.
7. Buyer's Representations
Buyer represents that he/she has the requisite power and authority
to enter into this Agreement and to perform the obligations under
this Agreement. Buyer represents that he/she has provided accurate
information to Post Marine Supply in purchasing products through
the Web-Site and that his/her offer to purchase products complies
with all applicable laws. Buyer acknowledges and agrees that he/she
is solely responsible for compliance with all applicable laws
and regulations concerning Buyer's purchase, possession, use,
or resale of the products. Buyer further represents that he/she
is familiar with the characteristics of the products, and will
comply with all laws, regulations, and standards applicable to
the possession, handling, processing or use of the products by
Buyer.
8. Indemnification
Buyer shall defend, indemnify and hold Post Marine Supply
and its suppliers, including, but not limited to, their affiliates,
agents, assigns, attorneys, employees, insurers, officers, predecessors,
representatives, and successors, harmless from and against all
claims, liabilities, costs and expenses (including, but not limited
to, those related to injury or to death of Buyer or other persons)
arising from or connected with (a) a breach by Buyer of this Agreement
or (b) the possession, handling, use, or resale of the products
by Buyer or others, including, but not limited to, any claims
alleging negligence on the part of Post Marine Supply. Post Marine
Supply may participate in the defense of any such claim for the
further protection of its own interests.
9. Limitation of Claims
Without limiting the scope of any other terms and conditions
herein, any and all claims related to products sold to Buyer through
the Web-Site shall be made within thirty (30) days after receipt
of the product to which the claim relates, or if for non-delivery,
after the scheduled delivery date thereof. Buyer's failure to
give Post Marine Supply written notice of any claim within the
applicable time period shall constitute an absolute and unconditional
waiver of such claim. In no event shall Buyer commence any action
against Post Marine Supply related to products sold to Buyer through
the Web-Site later than one year after receipt of the product
giving rise to such action.
10. Limitation of Liability
By using the Web-Site, you expressly agree that use of the
Web-Site is at your sole risk. The Web-Site is provided on an
“AS IS” and “as available” basis. Neither Post Marine Supply nor
its parent company, affiliates, subsidiaries, or designees nor
each of their respective officers, directors, employees, agents,
third-party content providers, designers, contractors, distributors,
merchants, sponsors, licensors or the like (collectively, “Associates”)
warrant that use of the Web-Site will be uninterrupted or error-free.
Neither Post Marine Supply nor its Associates warrant the accuracy,

11. Force Majeure

for any delay or failure to deliver any or all of the products
for causes beyond its reasonable control, including, but not limited
to, any cause or circumstance which makes impracticable the production,
transportation or delivery of the products. Post Marine Supply
may cancel an order to the extent the quantity not delivered is
due to any such cause or circumstance. In no event shall Post
Marine Supply be obligated to purchase products to replace
any quantity not delivered due to any such cause or circumstance.
In the event of any cause or circumstance excusing Post Marine
Supply, Post Marine Supply shall have the right to allocate
any remaining product supply among its customers, including those
not under contract, in a fair and reasonable manner, and Buyer
hereby releases Post Marine Supply from responsibility or
liability for any resulting incomplete fulfillment of Buyer's
order.
12. General
a) No waiver by either party of any breach of any terms or
conditions contained herein shall be construed as a waiver of
any succeeding breach of the same or any other terms or condition
herein. Nothing contained herein shall limit the remedies of Post
Marine Supply. All notices related to this Agreement shall be
in writing. The parties expressly agree that electronic communications
shall be considered “writings” for all purposes under applicable
law. If notice is not sent by electronic communications, notices
shall be deemed given when delivered to or deposited in the United
States mail, first class, postage prepaid, and, if to Buyer, sent
to the address identified by Buyer when registering to purchase
products through the Web-Site and, if to Post Marine Supply, 65
River St., New Rochelle, N.Y. 10801.
b) If any terms and conditions herein are held to be invalid or
unenforceable, such holding shall not affect the validity or enforceability
of any other term or condition herein.
c) These Terms and Conditions shall be governed by and construed
under the laws of the State of New York, United States of America,
without regard to conflict of laws principles. Any legal action
with respect to any transaction subject to this Agreement must
be commenced within one year after the cause of action has arisen.
Any actions arising out of products purchased through the Web-Site
shall be commenced in the state or federal courts of New York.
Buyer agrees to submit to the jurisdiction of these courts and
waives any claim that venue is improper for any reason in these
courts.

to the jurisdiction of these courts and waives any claim that
